There can be no distinction such as the Skilled and Unskilled among the workers as Life can only be defined as ‘Knowledge in Action’. All human beings process similar kind of information and use chemical energy to perform similar kinds of sequential, guided, purposeful and goal-oriented actions described as ‘Metabolism’. In fact, no man can perform Unskilled work.

I ask the US Congress and The US Department of Labor to discard the flawed Act and dump into the dustbin to put an end to the division of workers into White and Blue Collar. As such, each employee and his or her employer must make the determination about compensation or remuneration and agree upon the terms for wages and benefits for performing any kind of labor.

In my view, the Natural Sciences and the Medical Science in particular does not validate the concept of the White-Collar or the Managerial Class as no human being performs executive, administrative, or professional service while operating the metabolic functions of human bodies of their own. No man lives as the boss, the manager, the administrator, the executive officer, the ruler, the governor, or the controller of his own body.

I ask my readers to reject the assumptions and the criteria described by the Fair Labor Standards Act as they contribute to Unequal Employment Opportunities at the American Workplace. As such the Fair Labor Standards Act is not consistent with the Natural Law principle of Equality that formulates the Supreme Law of this Land.

Fact Sheet #17S: Higher Education Institutions and Overtime Pay Under the Fair Labor Standards Act (FLSA)

The FLSA requires that a non-exempt employee receive minimum wages for his or her work, as well as overtime wages whenever he or she works more than 40 hours in a workweek. Section 13(a)(1) of the FLSA, however, exempts certain employees who perform bona fide executive, administrative, professional, and outside sales duties from minimum wage and overtime requirements. These exemptions are often called the “white-collar” exemptions. This fact sheet discusses the applicability of these exemptions to jobs that are common in higher education institutions.

The Exempt vs the Non-Exempt Employees. The Fair Labor Standards Act (FLSA) is fundamentally flawed.

General Requirements for Exemptions

To qualify for a white collar exemption, an employee must generally satisfy three tests:

1. The employee must be paid on a salary basis that is not subject to reduction based on the quality or quantity of work (the “salary basis test”), rather than, for example, on an hourly basis;

2. The employee must receive a salary at a rate not less than $455* per week (the “salary level test”); and

3. The employee’s primary duty must involve the kind of work associated with the exempt status sought, such as executive, administrative, or professional work (the “duties test”).

Exemptions for Common Higher Education Jobs

Teachers

A teacher is exempt if his or her primary duty is teaching, tutoring, instructing, or lecturing to impart knowledge, and if he or she is performing that duty as an employee of an educational establishment. See 29 C.F.R. § 541.303. Educational establishments include elementary school systems, secondary school systems, institutions of higher education, and other educational institutions. See 29 C.F.R. § 541.204(b). If a bona fide teacher meets this duty requirement, the salary level and salary basis tests do not apply. See 29 C.F.R. §§ 541.303(d), 541.600(e). Given these standards, professors, instructors, and adjunct professors typically qualify for this exemption.

A faculty member who teaches online or remotely also may qualify for this exemption. The regulations do not restrict where bona fide teaching may take place, to whom the knowledge can be imparted, or how many hours a teacher must work per week to qualify for the exemption. The exemption would therefore ordinarily apply, for example, to a part-time faculty member of an educational establishment whose primary duty is to provide instruction through online courses to remote non-credit learners. The exemption could likewise apply, for example, to an agricultural extension agent who is employed by an educational establishment to travel and provide instruction to farmers, if the agent’s primary duty is teaching, instructing, or lecturing to impart knowledge. To determine a teacher’s primary duty, the relevant inquiry in all cases is the teacher’s actual job duties. Job titles or full/part-time status alone do not determine exempt status.

A teacher does not become non-exempt merely because he or she spends a considerable amount of time in extracurricular activities (such as coaching athletic teams or supervising student clubs), provided the teacher’s primary duty is teaching.

Coaches

Athletic coaches employed by higher education institutions may qualify for the teacher exemption. After all, teaching may include instructing student-athletes in how to perform their sport. But a coach will not qualify for the exemption if his or her primary duties are recruiting students to play sports or visiting high schools and athletic camps to conduct student interviews. The amount of time the coach spends instructing student-athletes in a team sport is relevant, but not the exclusive factor, in determining the coach’s exempt status.

Professional Employees

The FLSA provides for several kinds of exempt professional employees—such as learned professionals, creative professionals, teachers, and employees practicing law or medicine. In higher education, employees eligible for the professional exemption are often either teachers (as discussed above) or learned professionals (as described below). To qualify as a learned professional, the employee must satisfy three requirements:

1. The employee’s primary duty must be the performance of work requiring advanced knowledge;

2. The advanced knowledge must be in a field of science or learning; and

3. The advanced knowledge must be customarily acquired by a prolonged course of specialized intellectual instruction.

See 29 C.F.R. § 541.301. Unless the employee is a teacher or practicing law or medicine, he or she must also satisfy the above-referenced salary basis and salary level tests to be an exempt professional.

In higher education, examples of exempt non-teacher learned professionals generally include certified public accountants, psychologists, certified athletic trainers, and librarians. Postdoctoral fellows, who conduct research at a higher education institution after completing their doctoral studies, likewise generally meet the duties requirements of the learned professional exemption, and they may additionally qualify for the teacher exemption if teaching is their primary duty. Of course, an employee’s qualification for the exemption depends on his or her actual job duties and education. Job titles alone are not sufficient for determining whether an employee satisfies the duties test.

Administrative Employees

Various employees at higher educational institutions may qualify as exempt administrative employees. The administrative exemption applies when the following requirements are met:

1. The employee’s compensation must satisfy the above-referenced salary basis and salary level tests;

2. The employee’s primary duty must be the performance of office or non-manual work directly related to the management or general business operations of the employer or the employer’s customers; and

3. The employee’s primary duty must include the exercise of discretion and independent judgment with respect to matters of significance.

See 29 C.F.R. § 541.200. Such administrative employees in higher education might include, for example, admissions counselors or student financial aid officers. An employee’s qualification for the exemption depends on his or her actual job duties; job titles alone are not sufficient for determining whether an employee satisfies the duties test.

Notably, there are specific regulatory provisions for certain administrative employees—known as “academic administrative employees”—whose primary duty is performing administrative functions directly related to academic instruction or training in an educational establishment. To be exempt as an academic administrative professional:

1. The employee must satisfy the above-referenced salary basis and salary level tests or receive a salary of at least the entrance salary for teachers in the same educational establishment; and

2. The employee’s primary duty must be to perform administrative functions directly related to academic instruction or training in an educational establishment.

See 29 C.F.R. § 541.204. Employees who work in higher education but whose work does not relate to the educational field (such as work in general business operations) do not qualify as exempt academic administrative employees. See id.

In higher education institutions, exempt academic administrative personnel generally include department heads, intervention specialists who are available to respond to student academic issues, and other employees with similar responsibilities. Exempt administrative personnel would likewise generally include academic counselors who administer school testing programs, assist students with academic problems, and advise students concerning degree requirements. Again, whether an employee satisfies the duties test for these exemptions depends on the employee’s actual job duties, not just the employee’s job title.

Executive Employees

To qualify for the executive exemption, an employee must satisfy the following tests:

1. The employee must receive compensation that satisfies the above-referenced salary basis and salary level tests;

2. The employee’s primary duty must be managing the enterprise or a customarily recognized department or subdivision thereof;

3. The employee must customarily and regularly direct the work of at least two or more other full-time employees or their equivalent (for example, one full-time and two half-time employees); and

4. The employee must have the authority to hire or fire other employees, or in the alternative, the employee’s suggestions and recommendations as to the hiring, firing, advancement, promotion, or any other change of status of other employees must be given particular weight.

See 29 C.F.R. § 541.100. Various positions in higher education institutions might qualify for the executive exemption, including deans, department heads, directors, and any other manager or supervisor whose job duties and compensation satisfy the above criteria.

Student-Employees

As a general matter, most students who work for their college or university are hourly non-exempt workers and do not work more than 40 hours per week. The following, however, are examples of students who often receive a salary or other non-hourly compensation:

· Graduate Teaching Assistants. Graduate teaching assistants whose primary duty is teaching are exempt. Because they qualify for the teacher exemption, they are not subject to the salary basis and salary level tests.

· Research Assistants. Generally, an educational relationship exists when a graduate or undergraduate student performs research under a faculty member’s supervision while obtaining a degree. Under these circumstances, the Department would not assert that an employment relationship exists with either the school or any grantor funding the student’s research. This is true even though the student may receive a stipend for performing the research.

· Student Residential Assistants. Students enrolled in bona fide educational programs who are residential assistants and receive reduced room or board charges or tuition credits are not generally considered employees under the FLSA. They therefore are not entitled to minimum wages and overtime under the FLSA.

An employment relationship will generally exist when a student receives compensation and his or her duties are not part of an overall education program. For example, students who work at food service counters, sell programs or usher at events, or wash dishes in dining halls and anticipate some compensation (for example, money or meals) are generally considered employees entitled to minimum wage and overtime compensation.

Compensatory Time at Public Universities

Public universities or colleges that qualify as a “public agency” under the FLSA may compensate non-exempt employees with compensatory time off (or “comp time”) in lieu of overtime pay. A college or university is a public agency under the FLSA if it is a political subdivision of a State. When determining whether a college or university is a “political subdivision,” the Department considers whether (1) the State directly created the entity, or (2) individuals administering the entity are responsible to public officials or the general electorate.

If the public university or college qualifies as a public agency, non-exempt employees generally may not accrue more than 240 hours of comp time. However, employees engaged to work in a public safety activity, an emergency response activity, or a seasonal activity may accrue as much as 480 hours of comp time. See 29 U.S.C. 207(o)(3)(A). Private higher education institutions may not pay employees comp time in lieu of overtime pay.

On Sunday, June 20, 2021, Father’s Day, I reflect upon the unique and special relationship between Jesus, the Son of Man and God. I am alien, foreigner, sojourner, stranger, tenant and traveler with no place to call home.

I describe myself as Simon a Cyrenian bearing the burden of the cross under compulsion and following Jesus. I reflect upon the words of Jesus on this Father’s Day. Before getting nailed to the Cross, Jesus expresses His special and unique relationship to God by addressing God as Abba or Father. After getting nailed to the Cross, I hear the final seven words cried out by Jesus. The special and unique relationship between the Father and the Son of Man suddenly disappears. The personal God gets transformed into impersonal God.

On this Father’s Day, I reflect upon the final words of the Son of Man. His words relate to the words of pain and anguish shared by King David, the King of Israel and the author of the Book of Psalms. The pain is the same. But, the Agony of the Cup and the Burden of the Cross are different. The Agony of the Cup gets revealed to Father. The pain of Crucifixion gets revealed to God. Father vs God. What is the difference? What makes the difference? What is the difference between personal God and impersonal God?

On this Father’s Day, I am reflecting upon the difference between the words Father and God, the two different words used by Son of Man before getting nailed to the Cross, and after the completion of the act of Crucifixion that is nearing its conclusion. In my analysis, the difference between Father and God reflects upon the nature of the relationship. The Father-Son relationship, partnership, bonding, association, the coming together, and the yoking cannot be experienced in the God-man relationship which imposes a degree of detachment, estrangement, separation, and alienation. For I describe myself as an alien, I bear the burden of the Cross as I painfully march to the destination when the struggle finally reaches its conclusion, at the ninth hour, I ask myself, “My God, Why have You forsaken me.”

WHOLE PATIENCE: TO KNOW, TO UNDERSTAND THE QUALITY, THE ABILITY, OR THE FACT OF PATIENCE, I PRAY TO THE SON OF MAN KNOWN AS JESUS, A NATIVE OF NAZARETH, GALILEE.

I pray to Son of Man, a native of Nazareth, Galilee to know, and to understand the quality, the ability, or the fact of “PATIENCE.” I am using the phrase “WHOLE PATIENCE” for Jesus clearly demonstrated His other supernatural abilities. Jesus had several options if He chose not to wait, not to tolerate, not to succumb, and not to experience the horrors of pain and humiliation imposed by crucifixion.

The Gospel of Luke 23:26, Matthew 27:31, and Mark 15:21 is of very special interest to the alien carrying the burden of the cross. The Gospel reveals God’s costly plan for redemption through crucifixion and the plan shifts the burden of cross from Jesus to the alien. The word redemption means to release, or freedom from payment of a price and the man’s freedom or deliverance, or liberation involving the greatest possible depth of suffering. The price paying concept lies at the heart of redemption and hence it is a costly action. A ransom-price is paid by Jesus and yet the alien is not set free from the burden of the cross. “For even the Son of Man did not come to be served, but to serve, and to give His life as a ransom for many.” (Gospel According to Saint Mark, Chapter 10, verse#45) The emphasis is on the giving of Life as a ransom. It is a completed act for Jesus who paid the ransom-price. Jesus performed this action with Whole Patience. It is immaterial as to whom Christ paid this price. For the alien, the only concern is to experience the results of this full redemption by receiving God’s grace and mercy through Christ and His Love. Jesus had gone through the whole of human experience including the worst horrors of pain and humiliation and it is unfair to leave the alien with the never ending burden.

Today, the alien is still carrying the burden of the cross while he slowly inches towards his final, earthly destination. The alien has no choice other than that of learning the art of Whole Patience. I am alien for I have not yet entered the Kingdom of Heaven on Earth.

WHOLE CHRIST–WHOLE LOVE–WHOLE REDEEMER:

Endurance is the ability to stand pain, distress, and fatigue; it is the ability to resist and withstand suffering and hardship with fortitude and patience.

THE TRIAL AND EXECUTION OF JESUS IS A LESSON TO THE ALIEN, A TEACHING TO KNOW AND UNDERSTAND THE QUALITIES OF PATIENCE AND ENDURANCE. ROMAN GOVERNOR PONTIUS PILATE THOROUGHLY SCOURGED JESUS AND ASKED PEOPLE IF HE NEEDS TO PUNISH MORE.

Endurance speaks of the ability to hold up under pain, to tolerate, to put up with, to bear pain without flinching. It is the Will, ability, quality, or fact of waiting without complaint. It demands steadiness, perseverance, self-control, resoluteness in the face of grave provocation. This ability to bear suffering results from firm sustained courage and it is a mistake to interpret endurance as cowardice. Jesus remained calm and unperturbed while people angrily shouted demanding his crucifixion.

The alien walking behind Jesus carrying the cross knows the Son of Man as a picture of stoicism displaying grit, and courage that refuses to succumb under any circumstances, a courage that involves utmost indifference to personal pain and suffering.

“THEN SOME BEGAN TO SPIT AT  HIM,  THEY  BLINDFOLDED  HIM,  STUCK  HIM  WITH  THEIR  FISTS,  AND  SAID, ‘PROPHESY!’ AND THE GUARDS TOOK  HIM  AND  BEAT  HIM .” GOSPEL OF   MARK, CHAPTER 14, VERSE#65.

TO WHICH LAND AND TO WHICH KINGDOM DOES THE ALIEN CARRYING THE CROSS TRULY BELONGS? WHO WILL SHARE THE PROPHESY?

THE SON OF MAN IS CRUCIFIED AND IT ONLY SPEAKS ABOUT HIS WILL TO REFRAIN FROM RETALIATION, AND FORBEARANCE. PEOPLE TAUNTED JESUS TO SAVE  HIS  OWN  LIFE  AND TO  COME  DOWN. THE ALIEN WITH THE NEVER ENDING BURDEN OF CROSS CHOOSES FORTITUDE EVEN IF IT IS TO BE  MISTAKEN  OR  MISINTERPRETED   AS WEAKNESS.

THE ROMAN GOVERNOR PONTIUS PILATE OR HIS SOLDIERS POSTED A WRITTEN NOTICE ABOVE THE CROSS ON WHICH JESUS WAS CRUCIFIED. THE NEVER ENDING BURDEN OF THE CROSS CARRIED BY THE ALIEN BEARS NO SUPERSCRIPTION.

Before marching to the place of crucifixion, Jesus was repeatedly taunted, mocked, and ridiculed by people, by criminals, by officials, by soldiers, by the high priest, King Herod, and Roman Governor Pontius Pilate. The ultimate act of indignity was that of calling Him, “THE KING OF THE JEWS” showing utter contempt for His failure to save His own life and get away from the Cross on which He was nailed. The alien without getting nailed is still carrying the burden of the cross enduring the ridicule, taunts, mockery, indignity, and utter contempt.

JESUS DID NOT EXPRESS ANY THOUGHTS OR FEELINGS OF SELF-PITY AFTER GETTING NAILED TO THE CROSS. JESUS SAID, “FATHER, FORGIVE THEM, FOR THEY DO NOT KNOW WHAT THEY ARE DOING.”(THE GOSPEL OF ST LUKE, CHAPTER 23, VERSE#34). THE NEVER ENDING BURDEN OF CARRYING THE CROSS IS NOT YET FORGIVEN.

Jesus did not rebuke the people who offended and punished Him. Jesus did not express any desire to retaliate against them and did not express any thoughts or feelings of Self-Pity. Jesus after His crucifixion said, “Father, forgive them, for they do not know what they are doing.”( The Gospel According to Saint Luke, Chapter 23, verse#34)

  • There is no easy cure, and there is no easy remedy to the never ending burden of walking with the cross.The alien’s problem is that of alienation or estrangement from his own true or real nature that God implanted in the man while making the man in His own image. The man lives as an ‘alien’ for the man has lost his relationship with his own LORD God Creator. The divine nature of the Son of Man becomes self-evident when the alien learns the Art of Patience and Endurance.     I am sharing a collection of images that depict Jesus when the Roman Governor Pontius Pilate presented Him to a mob of people who gathered outside the palace shouting to crucify Jesus. This alien has no access to care or comfort while he faces the difficult problems of his simple, mortal existence.     The doctrine of One and Only One God or Monotheism is not compatible with the idea of Secularism

    The doctrine of One and Only One God or Monotheism is not compatible with the idea of Secularism.

    The Doctrine of One and Only One God or the Doctrine of Monotheism is not consistent with the Doctrine of Secularism:
    The discussion must address the core issue that relates to the compatibility of religious doctrine and the political doctrine. If a country like Pakistan chooses Islam as its national identity, it cannot be secular at the same time. The problem is not due to the political philosophy or doctrine  of Pakistan. The problem simply relates to the religious doctrine called Islam. So, we have to examine the religious doctrine called Islam which is just a variation of the religious doctrine of Jews, Christians, and Sikhs who proclaim belief in One and Only One God. Such religious beliefs are always inconsistent with the concept of Secularism.
    The central concept of Monotheism, the concept of One and Only One God is as much flawed as the Heliocentric theory proposed by Copernicus. I ask people to understand the concept of LORD God Creator taking into account the creative abilities of God. It is apparent that God has chosen to be simultaneously different without any concern to manifest His singularity. Each created object, either the celestial object or the living thing always exists as an Individual thing with its own Individuality without any choice of its own. There are no duplicates in this created world and the universe. Each planet displays its own unique, original, one of its own kind of rotational spin while the planets may orbit or revolve around the Sun. The motions of the Sun around the Milky Way Galactic Center are of no consequence to the living experience of the man on the surface of Earth. The life span of the man, his life journey is measured by the apparent Sunrise and Sunset while the Sun moves across the arched dome that the man describes as Sky or Heaven. Even with the help of the latest reproductive technologies such as cloning, the living things including the bacteria can only exist as Individuals with Individuality. This Individualism exists and is preconditioned by the Individual’s connection to an external source of energy without concern for the fate of the social group to which the Individual may belong. I am not surprised to read about the Resurrection of Christ while the Jews and Christians still lead their own mortal existence without any choice of their own. Jesus, the Son of Man retained His Individuality after His Resurrection. Even with the Second Coming of the Christ, the man would still exist as an Individual with Individuality and each resurrected Individual may have to discover his/her own connection to the Creator God making it impossible to recognize God as a fact of shared experience. The cognitive abilities of the man are not designed to let the men share their individualistic experiences. The experience of Moses on Mount Sinai was not a collective experience of the Jews. The individualistic experience of Moses was never replicated. I can read about it but cannot experience it. There are no two daughter cells that are alike.
    In my analysis, the Hindu concept of God is consistent and is compatible with the political doctrine of Secularism. The Monotheist does not admit the possibility of God being simultaneously different. The Monotheist does not agree that my individualistic experience of God could be different from his belief in One and Only One God. The First Amendment to the US Constitution tries to address the threat posed by the doctrine of Monotheism.

    The Concept of Monotheism: “ONE AND ONLY ONE GOD” 

    The concept of Monotheism is fundamentally flawed. I understand that this concept originated in India and spread to other nations. Apart from members of ‘Arya Samaj’, Sikhs, and other followers of Vedic rituals, it gained more attention among the followers of Prophet Muhammad. 

    Firstly, the LORD God Creator has not given to the man the ability to directly experience God’s existence. The human mental experiences of all kinds are conditioned by Fundamental Forces such as the Gravitation. Man has the ability to subjectively and objectively experience his own living condition and not that of God. The speculative nature of the Theory of Monotheism becomes apparent when we verify the Theory by finding its correspondence to an external reality. You may search the entire physical world, you will not find the One and Only One God of your imagination. That God is an idea, a mere mental percept without any correspondence with an external Object. You cannot find One and Only One God in the ‘Transcendent’ Realm for the man is conditioned. Man cannot cross the boundaries of the Physical or Immanent Realm. In fact, the One and Only One God of Jews, Christians, Muslims, Vedic Hindus, and Sikhs are not the same. However, I want to make it clear that I admire the Bhagats and their traditions of Devotional Worship of God. The issue is not that of accepting or rejecting the Vedas or Gurbani. The Man arrives in the world all alone. The Man departs from the world all alone. Bhagat Kabir communicates this problem of Individualistic Existence because of the separation of the Transcendent and the Immanent Realms. The Man cannot hope to ride on the shoulders of his Guru, Master, or Teacher. The man who departs from this world has to reach his Final Destination using his own effort, actions, or “KARNI.” Even, the Guru has to reach his Final Destination using his own effort, actions, or “Karni.” The disciple or Chela cannot find any exceptions to this rule. “Guru ki karni Guru jayega, Chele ki karni Chela.”

    Monotheism is a term that was introduced in an effort to study religions. It is described as a religious belief that only one God exists. This belief in a single and transcendent God contrasts particularly with Polytheism which is described as a belief in many gods.

    Such oversimplification may conceal the true identity of the Gods of Monotheism. Judaism, Christianity, and Islam are the principal Monotheistic religions. The demarcation between these faiths is very easy to determine and it is not so easy to establish their common ground. Dogmatic differences or differences in articles of faith must be explicitly recognized.

    The identity of the Divine is not represented merely by the philosophical speculations about God’s essence but by the God whom men worship in all the acts of piety which comprise the rituals of religion.

    If you consider the dogmas of religion; the articles of religious faith-based solely on divine revelation, you would conclude that the Gods of Monotheism live in different Heavens. There is no chance that the God of children of Israel, The Holy Trinity (Father, Jesus, the Holy Ghost/Spirit), and the God of Ishmael could coexist in the same transcendent or immanent realm.

    The doctrinal differences are too many. There are very serious differences on matters such as salvation, the nature, and mission of the synagogue/church/masjid, the places of their worship, its rituals and sacraments.

    The Monotheist concept of religious belief has not nurtured the concept of shared humanity that is united in religious brotherhood.

    The desire to assert the dominion of the one and only true God has often lead to violence and intolerance. Historically, Monotheists have killed to gain theological as well as political dominance. The Gods of Monotheism have caused far more wars and conflicts than the many gods of Polytheism.

    The adherence to an ABSOLUTIST thesis that only my God is God has resulted in a strict demand for intolerance of others holding different creeds. The Israelites practiced the worship of one God without denying the existence of other gods and the Torah also instructs them to act decently toward one another. The trinitarian creed of Christianity sets it apart from other religions.

    The Islamic interpretation of Monotheism is more literal and uncompromising than that of any other religion in the world. ‘TAWHID’ or oneness of God is the foremost article of the Muslim faith. Muslim belief is based upon the unity of Allah and the prophethood of Muhammad. To bestow Allah’s indivisible reality upon another god is considered by Muslims to be a lie, and stands as the only sin which Allah will not forgive. The Holy Book of Quran mentions that to attribute divinity to a created entity is the only unpardonable sin.

    The only point of agreement amongst Monotheistic religions is that of their hatred of idols. Polytheism is not an acceptable choice and it is considered as a form of Atheism. Idolatry ranks as perhaps the most common topic in the Bible and Quran.

    The people of India are ridiculed and are scoffed at because of their conceptions of God as anthropomorphic. Indians are verbally assaulted every day by Christian Evangelists for worshiping inanimate objects and historically, Indians were punished for being patrons of idolatry.

    In an effort to wipe out idolatry from India, numerous temples were destroyed and about 60 to 80 million people were killed between 1000 and 1525 CE.

    Psalm 115, verses 4 to 8 from The Old Testament Book of Psalms, illustrates the hatred of idols:

    “But their idols are silver and gold, 

    made by the hands of men. 

    They have mouths, but cannot speak, 

    eyes, but they cannot see; 

    they have ears, but cannot hear, 

    noses but they cannot smell; 

    they have hands, but cannot feel, 

    feet, but they cannot walk, 

    nor can they utter a sound with their throats. 

    Those who make them will be like them, 

    and so will all who trust in them…” 

    THE INDIAN CONCEPT OF GOD WORSHIP 

    The Vedic Scripture of Shukla Yajurveda in its final chapter of ‘Isha Upanishad’ (Ishavasya Upanishad), verses 12-14 recommend the worship of the Divine in its Immanent (manifest, visible phenomenal forms) and it’s Transcendent (unmanifest, invisible, Absolute) forms. 

    “Into deep darkness falls those who follow the immanent. Into deeper darkness fall those who follow the transcendent. By the worship of the Manifested, one end is attained; by the worship of the Unmanifested, another.

    Thus we have heard from the wise men who taught us this. He who knows at the same time both the Unmanifested and the Manifested, he crosses over death through knowledge of the manifested and attains immortality through the knowledge of the First Cause.”

    Shavuot is a Jewish celebration that gives thanks for the Torah . Jews believe that the Torah is given to them to act as a guide for their lives. Shavuot remembers the time that God spoke to Moses on Mount Sinai and gave him the Ten Commandments and other laws. In 2021Shavuot begins at sunset on Sunday, May 16 and ends at sundown on Tuesday, May 18.

    CELEBRATION OF LOVE AS A HOLIDAY TRADITION: IN JEWISH TRADITION, THE DAY OF PROCLAMATION OF TORAH TO THE JEWS AT MOUNT SINAI IN EGYPT IS CELEBRATED AS SHAVUOT, THE HARVEST HOLIDAY, THE FEAST OF WEEKS, THE HOLIDAY OF THE FIRST FRUITS.     The word “LOVE” does not appear in the TORAH ( Law) given to the Jews at Mount Sinai. I conducted a study of the holiday traditions of the US and I am totally surprised to note that there is no traditional celebration of the Proclamation of the two Great Love Commandments of Jesus. Jewish Holiday “SHAVUOT” celebrates the giving of the ‘TORAH’ (the LAW or Instruction) to the Jews. God gave the Ten Commandments ( The Decalogue, The Code of The Ten Words)on the sixth night of the Hebrew month of ‘Sivan’. Shavuot always falls 50 days (PENTECOST) after the second night of Passover. The 49 days between Passover and Shavuot are known as ‘Omer’. While retaining the essence of The Code of The Ten Words Jesus changed the Operating Principle of the TORAH or The Law. Jesus instructs that the Law must be followed by His believers not through the use of force or authority but by simply embracing the equally powerful influence called “LOVE.”

I am using the term ‘Whole Body’ to describe the perfect unity of body, mind, heart, soul, and God that establishes man as a Whole Being. Love is central to the man’s relationship to God and the man’s relations with other persons. The term love includes the feelings or the emotion of love expressed by a person (“The Subject”) and it involves a personal experience evoked when another person (“The Object”) reflects the feelings of love. Love has to be known as “The Medium” that generates the attachment or devotion to another person; and this attachment implies connection by ties of affection, sexual attraction, devotion, friendship, goodwill, compassion, respect, trust, and commitment. This kind of care and concern for a person, or persons in a relationship could be called ‘Whole Love’ if whatever is done for Love occurs beyond good and evil.

    Holiday is a day of freedom from labor sanctioned by God, and it is set aside for leisure and recreation to renew man’s relationship with his Creator. In Civil Society, certain days are set aside by Law or Custom and Traditions for the suspension of official business activities and very often in commemoration of some important events in national life. I am using the term ‘Whole Holiday’ to recognize a specific day that is set aside by Human Law in recognition of the Divine Law that is conducive to the development of harmonious, or wholesome interpersonal relationships that are essential to promote the health, and well-being of all people. In the US, there are several holidays that are legal and none of them directly address the central issue of developing Love relationships.

    Christmas Day Holiday celebration should reflect the very essence of Christianity.  The Gospel according to Apostle John, Chapter 3, verse# 16 declares: “For God so loved the world that He gave His only begotten Son, that whoever believes in Him shall not perish but have eternal life.” The Christmas tradition is about the Joy that is associated with the birth of baby Jesus and the exchange of gifts to express the sense of happiness. Christmas holiday is not in remembrance of God’s Law. Jesus Christ has established ‘LOVE’ as the God’s Greatest Commandment. The Gospel according to Apostle Matthew (Chapter 22, verses#37-40), and The Gospel according to Apostle Mark (Chapter 12, verses# 28-31) describe the Commandments of Love: “Love the LORD your God with all your heart and with all your soul and with all your mind and with all your strength. This is the first great commandment. The second is this: ‘Love your neighbor as yourself.’ There is no commandment greater than these. All the Law and the Prophets hang on these two Commandments.” The Gospel according to Apostle John, Chapter 13, verse# 34 describes the need for neighborly relations among people based upon Love: “A new command I give you: Love one another, as I have loved you, so you must love one another.”

THE LAST WEDNESDAY OF JULY SHOULD BE A LEGAL HOLIDAY TO CELEBRATE THE SPIRIT OF CHRISTMAS IN JULY.

    In the United States, we have no Law, or a cultural tradition to commemorate the event in which Jesus Christ has issued the two great commandments asking people to observe the Law of ‘Whole Love’ which demands, 1. The Love of God with Whole Body, Heart, Mind, and Soul, and 2. The Love of Neighbor as a requirement of God’s Law for man. After my ‘Whole Discovery’, the discovery of the experience of ‘Whole Love’ at Whole Foods Market, Ann Arbor, Michigan on Wednesday, July 30, 2014, I have decided to promote the establishment of a ‘Whole Tradition’ to follow the Spirit of the ‘Whole Law’ to truly observe the Commandment of ‘Whole Love’. To commemorate my ‘Whole Discovery’, I am writing this appeal to ask all the members of the US Congress to approve a new Law to observe the last Wednesday of July as the ‘Whole Love Holiday’. The choice of Wednesday is very appropriate as most other legal holidays are observed on Mondays as a matter of convenience and not for the purposes of obedience to a Divine Law which should be the source and inspiration for the Human Law. The concept of ‘Whole Love’ represents the ‘Whole Law’ that is explicitly pronounced by Jesus Christ as the only Commandment that man must follow and observe in his lifetime. To acknowledge the ‘Whole Law’, to celebrate its pronouncement, we need a new ‘Whole Tradition’ which is reflected by instituting a new ‘Whole Holiday’.

My understanding of Mother and Motherhood comes from the study of the building blocks of Life. The most important building block of human life is the fertilized Egg Cell.

    The Father and the Mother – The Principles governing Life:

Lord Shiva and Goddess Parvati – The Indian Tradition describes them as the First Couple or ‘Adi Dampatulu’ or the Original Father and Mother of the human race. The Tradition recognizes the existence of a Father and a Mother Principle.

    MAATRU DEVO BHAVA, PITRU DEVO BHAVA  – THE DIVINITY OF MOTHER AND FATHER:  

    Father is described as the male parent, an ancestor, an originator, and as a Controller. Very often, in the Land of India, God is considered as both the Father and the Mother of all life forms. Mother is described as the female parent and something that is regarded as a ‘Source’. In Indian tradition, Father may be viewed as the ‘Prime Cause’ and Mother is the Source of ‘Prime Energy’. Mother is the source of energy in performance of all kinds of actions and in accomplishment of all kinds of work. The Mother Principle represents the Endeavor/Work/Effort that makes action possible. If Life is defined as function at the level of biological molecules, Mother represents the Source or the Origin of these organic molecules; Mother is the Source of Energy for the synthesis of these organic molecules; and Mother is the Source of Knowledge that provides the ability of recognition and the ability to use the molecules in a sequential manner to manage the biochemical reactions of these organic molecules to function as Life.

    The complex, multicellular human organism begins as a single cell. That single cell is the source of life, energy, and knowledge.

This cell known as Oocyte develops into Human Ovum or Egg Cell which begins the life of a new human organism after an event called Fertilization.

    I, as a human organism exist in this world as I arrived from a previously existing ‘Mother Cell’. By repeated cell growth and cell division or replication known as ‘Mitosis’, the human organism grows and develops into a form containing thousands of billions of cells. This process of development is called ‘Morphogenesis’ which involves not only cell growth but differentiation into specialized types of cells. All the tissues and organs of which the human body is composed have originally developed from a microscopic cell known as ‘Ovum’ or the ‘Egg Cell’. This Ovum or Egg Cell may be regarded as a perfect cell and could be described as ‘Mother Cell’. All the solid tissues in the human body can be shown to consist largely of similar cells; it is true that they may differ, but they are essentially similar to an Ovum. The Ovum is a reproductive cell that is adapted to meet the nutritional requirements of the early developmental stages of the embryo. It is always a large cell because it contains sufficient cytoplasmic substance for the development of a self-sufficient embryo. Some of the substance which is packaged in yolk particles contains cell components; typically an Ovum contains sufficient quantities of components for many cells. Thus the Ovum need not grow as it divides; as the nuclei divide, the cytoplasm subdivides until the Ovum consists of a large number of normal-sized cells. By contrast, the male reproductive cells known as ‘Spermatozoa’ contain very little cytoplasm and they cannot further divide into new cells.   

    THE SOURCE OF LIFE – PROTOPLASM:

    The most significant feature of the similarity between the cells of a man and that of the ‘Mother Cell’ from which he had arrived is  presence of a soft gelatinous, semi-fluid, granular material inside the cell. This substance known as ‘Protoplasm’ is similar to that found in the Ovum. The Ovum consists of this viscous, translucent, colloidal substance enclosed in a membrane called Plasma Membrane. A small spherical body called nucleus is embedded in the protoplasm. The protoplasm could also be differentiated into cytoplasm and nucleoplasm based upon its location. Cytoplasm refers to protoplasm located outside the nucleus. Nucleoplasm refers to protoplasm located inside the nucleus. The two essential features of any living cell in the human body are that of  presence of protoplasm and the nucleus.

    The most striking characteristics of protoplasm are its vital properties of “Motion” and “Nutrition”. Protoplasm has the intrinsic power to change its shape and position. Motion of protoplasm is called ‘amoeboid movement’ as it resembles the movements observed in the Amoeba proteus animalcule. Nutrition is the power which protoplasm has of attracting itself the materials necessary for its growth and maintenance from surrounding matter and environment. The Egg Cell or the Ovum is the Source or the Mother of Life. This living matter, living substance, or corporeal material has divine attributes. It is conscious, it is aware, and it performs cognitive functions to sustain its own living condition.

Life always comes into existence as a new, original object and displays variation from other members of the same or different species.

    Heredity is the sum of all biological processes by which particular characteristics are transmitted from parents to their offspring. A child inherits a genetic constitution from its biological parents. This hereditary endowment, the total of the genes that the child has received from both parents is called the genotype. The genotype of an individual is formed from the constituents of the genotypes of his parents. The genotype in a fertilized Egg Cell influences the developmental pattern of the child. Progeny is not exact duplicates of their parents and usually vary in many traits. Heredity and Variation are two sides of the same coin. The outward appearance of an organism is called the phenotype. The same individual shows different phenotypes in childhood, in adulthood, and in old age. The genotype, on the other hand, does not change during an individual’s life. Each cell in the human body contains the same total genetic information that was present in the fertilized Egg. However, the cells are not identical. In different types of cells, groups of genes are controlled ( in effect switched on and off ) by various biochemical processes, so that each cell manufactures the proteins and structures needed for it to function. Cells are regulated by the DNA in the nucleus and by the transfer of selected portions of the DNA information to the cytoplasm through the intermediate molecules of ‘Messenger RNA’. It is estimated that, on average, only about 10 percent of the genes of any cell are functional; selection of functional genes varies with the type of cell. This biological phenomenon of selective gene functioning may contribute to what I term as ‘The Law of Individuality’. Deoxyribonucleic acid or DNA accounts for the ability of all living matter to replicate itself exactly and to transmit genetic information from parent to offspring. The child maintains its individuality by selectively switching the inherited DNA on and off. The Law of Individuality applies to all living organisms. Despite the basic biological, chemical, and physical similarities found in all living things, diversity of life exists not only among and between species but also within every natural population.

The Mother Cell does not manufacture the new multicellular organism called child. A child is always a created object even when it derives its life from a Mother Cell.

    To maintain life an organism not only repairs or replaces (or both) its structures by a constant supply of the materials of which it is composed but also keeps its life processes in operation by a steady supply of energy.

The man exists as an Energy Seeker, a heterotroph and the human existence is possible because of an Energy Provider. Mother is the Source of Energy for man’s physical and mental work.

    Living systems must be supplied energy for continual synthesis of new organic molecules and to replace or to repair broken organic molecules. This functional activity; the processes of synthesis and breakdown of organic molecules by a living cell, is known as metabolism. Metabolism involves a living system’s continual exchange of some of its materials with its surroundings, principally in the process of building up or destroying its protoplasm. growth involves a higher rate of synthesis of protoplasm than a rate of breakdown of that matter.

    Organisms acquire energy for their metabolism by two general methods and could be classified as autotrophs or self feeders and heterotrophs or feeders of other organisms. Plants are known as Photoautotrophs as they acquire useful free energy from the energy of Sunlight. In a process known as Photosynthesis, plants use Sunlight to break water into Oxygen and Hydrogen. Hydrogen is then combined with Carbon dioxide to produce such energy-rich molecules as Adenosine triphosphate (ATP) and carbohydrates and the Oxygen is released back into the atmosphere. Humans and most other animals are known as heterotrophs – these organisms acquire energy by the controlled breakdown of pre-existing organic molecules ( food ) supplied by other organisms. Humans utilize the atmospheric Oxygen ( released by plant life ) to combine chemically with organic matter ( food ) they have eaten and release Carbon dioxide and water as waste products. Metabolic processes do not occur in one step. It is not similar to burning sugar in air.

    The glucose, a simple sugar is broken down by a series of successive and coordinated steps, each mediated by a particular and specific enzyme. The human organism extracts useful energy by a metabolic process described as Oxidation-Reduction Reactions. The glucose is broken down in a series of about 71 enzymatically catalyzed steps. The first 11 of these biochemical reactions do not involve the use of Oxygen. These Oxidation-Reduction Reactions occur in intracellular organelles known as Mitochondria in the cytoplasm of cells.   

    MITOCHONDRIA – THE POWERHOUSE OF CELLS:

    Mitochondria are typically sausage-shaped particles about 0.5 to one micron wide and about 5 to 10 microns long. They are surrounded by an outer unit membrane which controls the passage of material into and out of the mitochondria and govern their internal environment. The inner membrane is the site of the respiratory functions that make the mitochondria the so-called Powerhouse of the Cell. The inner membrane is folded repeatedly into shelf like folds called cristae which contain the enzymes that play an essential role in  conversion of the energy of foodstuffs into the energy used for cellular activities.   

    MITOCHONDRIA AND CHLOROPLASTS – A DIVINE SOURCE FOR ENERGY ACQUISITION:

    Mitochondria and Chloroplasts found in the green plant cells perform the same fundamental processes. The Chloroplasts contain the green colored pigment known as Chlorophyll. The Chloroplasts convert the energy of Sunlight into energy-rich ATP and use ATP to convert Carbon into specific organic substances. The most important equations for living things are mutually inverse. Respiration of human organisms represents the reverse of Photosynthesis of Green Plants. Both Mitochondria and the Chloroplasts are semi-independent and self-reproducing parts of the living cells. They have a degree of autonomy and they are unlike the other components of cells. Mitochondria contain DNA in the form of a Chromosome arranged in a ring. The DNA of  Mitochondria has different distribution of bases from that of the DNA found in the Chromosomes present in the nucleus. Mitochondria carry the genes for their own replication and for the enzymes found in them. They can synthesize some of their own proteins and reproduce by themselves. In one respect the mitochondria function as the parts of the cells and in another respect, they behave like independent organisms that reproduce on their own.

    The Mother Cell is the source of Mitochondria found in all the cells of my human body. During the Growth and Development of Human Embryo and Fetus, all the newly formed cells contain Mitochondria derived from the Egg Cell. Hence, mother as a biological parent represents the Source of Energy for all the Living Functions and activities of her children. I cannot move a muscle in my body without drawing energy supplied by the maternal Mitochondria which continue to live and replicate establishing my mother as the Source of Energy for my existence during my entire Life’s Journey.   

    ANGEL OF KNOWLEDGE – MOTHER – SOURCE OF KNOWLEDGE:   

    Life is the state of an individual characterized by the capacity to perform certain functional activities including the ability of responsiveness. Life is further characterized by  presence of complex transformation of organic molecules and by organization of such molecules into the successively larger units of protoplasm, cells, organs, and tissues. Hence, I have defined Life as “Knowledge in Action.”

Indian Tradition recognizes Mind, and Intellect as aspects of Material Energies. Life functions with Knowledge implanted into Living Organisms which display the characteristics of awareness, responsiveness, alertness, and consciousness.

    Responsiveness represents the ability of an organism to change in response to alteration in its environment. Responsiveness, alertness, awareness, and consciousness separates living from nonliving matter and defines life’s underlying principle. Living cells are aware or conscious of the environment in which they exist as well as the state of their own internal environment. The one very important part of environment of a cell is other cells. The ability called awareness and responsiveness is important for recognition, association, and cooperation between cells. Cells function together by exchanging chemical signals.   

    THE BIOLOGICAL MEMBRANE – AN ORGAN OF SENSE PERCEPTION:

    Cell is the most elementary unit of Life. Cell is bounded by a Plasma Membrane which is more correctly described as a Biological Membrane. It separates the cell from the environment and from other cells. It helps to maintain a constant milieu in which intracellular reactions occur. The Biological Membrane allows a highly controlled exchange of matter across the barrier it poses, some compounds are able to pass through the membrane easily, others are blocked. Cells contain various internal structures such as the nucleus, and mitochondria, each of which is enclosed by a Membrane. Both the Biological Membrane and some of the intracellular membranes are parts of a continuous Membrane System that extends through much of the body of the cell. It serves two purposes. A compartmentalization of  cell is required for many cellular activities, including uptake and conversion of nutrients, synthesis of new molecules, production of energy, transportation, and release of cell products, and regulation and coordination of metabolic sequences. The cellular organelles are protected from one another’s enzymatic activities, and those of the cytoplasm. The Biological Membrane System functions like an Organ of Sense Perception and maintains the responsiveness of the cell.   

    THE CYTOPLASMIC OR MATERNAL INHERITANCE:   

    Deoxyribonucleic acid or DNA accounts for the ability of all living matter to replicate itself exactly and to transmit genetic information from parent to offspring. While offspring inherit a genetic constitution and hereditary traits from both parents, some characteristics are inherited through the maternal line only. For example, there are no Chlorophyll containing Chloroplasts in pollen grains of  ( male ) flowers. The act of Pollination does not contribute this most important characteristic known as Chloroplasts. Chloroplasts are found only in the Egg Cells of  ( female ) flowers. Similarly, humans inherit the Powerhouses called Mitochondria only from Maternal cytoplasm. A Cytoplasmic Inheritance is entirely Maternal. Human functions that involve Sensory Perception, Mental Cognition, Learning, and the functions of Memory and Consciousness should be viewed as functions of the cytoplasm. Cytoplasm represents the Seat of Knowledge. Man begins Life as a single cell with its cytoplasm. The cell grows and divides while building more of its cytoplasm. Knowledge is    Fact of Knowing,  State of Knowing, and  Act of Knowing a range of information, the Mother or the Source of Knowledge is the Maternal Cytoplasm inherited from the Egg Cell, Ovum, or the Mother Cell.

    WHY INDIA CELEBRATES HOLI: THE LEGENDS BEHIND THE FESTIVAL OF COLOR – CNN

    New Delhi (CNN): It’s the bold image of India most often seen in ad campaigns, films and music videos.

    But what is Holi and why do Indians celebrate it?

    The beginning of Spring

    Holi is a Hindu festival that marks the start of Spring.

    Celebrated across India, it’s an ancient festival with the first mentions of it dating all the way back to a 4th century poem.

    It was even described in detail in a 7th century Sanskrit play called “Ratnavali,” written by the Indian emperor Harsha.

    “Witness the beauty of the great cupid festival which excites curiosity as the townsfolk are dancing at the touch of brownish water thrown … Everything is colored yellowish red and rendered dusty by the heaps of scented powder blown all over,” wrote Harsh.

    How it looks today

    Although a Hindu festival, Holi is celebrated by Indians across the country and is a great equalizer.

    Children can douse elders with water, women splash men with color and the rules of caste and creed are briefly forgotten with everyone taking part.

    The evenings are spent visiting friends and family.

    A national holiday, it takes place on the last full moon day of the Hindu lunisolar calendar month, which is usually March.

    This year’s national holiday falls on Monday, March 29.

    The festival takes place a day earlier in the eastern states of West Bengal and Odisha. In some parts of northern Uttar Pradesh state, the festivities take place over a week.

    Mythological roots

    The roots of the festival lie in the Hindu legend of Holika, a female demon, and the sister of the demon, King Hiranyakashipu.

    Hiranyakashipu believed he was the ruler of the universe and superior to all the gods.

    But his son, Prahlad, followed the god Vishnu, the preserver and protector of the universe.

    Prahlad’s decision to turn his back on his father left Hiranyakashipu with no choice. He hatched a plot with Holika to kill him.

    It was a seemingly foolproof plan; Holika would take Prahlad onto her lap and straight into a bonfire. Holika would survive because she had an enchanted shawl that would protect her from the flames.

    But the plan failed. Prahlad was saved by Lord Vishnu and it was Holika who died as she was only immune to fire if she was alone. Soon after, Lord Vishnu in His Narasimha Avatar killed Hiranyakashipu and Prahlad became king.

    The moral of the story is that good always triumphs over evil.

    The love story behind Holi

    In modern day Holi celebrations, Holika’s cremation is often reenacted by lighting bonfires on the night before Holi, known as Holika Dahan.

    Some Hindus collect the ashes and smear them on their bodies as an act of purification

    Rangwali Holi takes place the next day and is an all-day affair where people throw and smear colored powder on each other.

    The tradition of throwing colored powder and water is believed to originate from the mythological love story of Radha and Krishna.

    Krishna, the Hindu god depicted with dark blue skin, is believed to have complained to his mother about Radha’s fair complexion.

    To ease her son’s sadness, his mother suggests he Radha’s skin color by smearing her with paint. It’s believed that this is where the custom of smearing loved ones with color during Holi came from.

    I was granted Short Service Regular Commission in the Indian Army Medical Corps during September 1969 while I was studying in Kurnool Medical College, Kurnool, Andhra Pradesh, India. On March 26, 1971 I was serving in the Military Hospital, Ambala Cantonment, Haryana, India undergoing the professional training to serve as a Medical Officer in the Indian Army Medical Corps. It was becoming increasingly clear that a huge crisis was brewing up in East Pakistan with immediate consequences to my military career. It did not take too long for the real possibility of War between India and Pakistan to materialize on account of a major influx of Bangla refugees into India from East Pakistan.

    On July 26, 1971, I finished my professional training and was granted two months of annual leave. Just after a month of my leave, I received a telegram at my home in Rajahmundry, that asked me to immediately report back to my military duty at the Military Hospital in Ambala. On September 22, 1971, I was promptly dispatched to serve in Special Frontier Force-Establishment No. 22-Vikas Regiment to begin my military career as a Medical Officer and got fully involved in the launching of military action to initiate the Liberation of Bangladesh.

    The term ‘Refugee’ has entered my life story with the tragic humanitarian crisis in Bangladesh. The term ‘Refugee’ is also central to my military mission in the Special Frontier Force where I worked with thousands of Refugees who were brutally expelled from Occupied Tibet. On March 26, 2021, the term ‘Refugee’ is still the central focus of my life story. My direct, physical involvement with the problems of Refugees from Bangladesh and Tibet has impacted my life journey and today I think of myself as a Refugee without Refuge while I may live in a Free Country.

    I am pleased to share the blog post titled “Looking Away From Genocide” authored by Gary J Bass, Professor of Politics and International Affairs at Princeton University. This blog includes excerpts from the conversation between US President Richard M Nixon, and US National Security Adviser Dr. Henry Alfred Kissinger. President Nixon makes a direct comparison to the slaughter in East Pakistan to other atrocities against humanity and asks Kissinger for his opinion on Biafra massacre(Nigeria) and the persecution of Jews in Germany by Hitler. President Nixon reveals his personal understanding of such historical events in this brief conversation and it would have a most chilling effect on any reader. I am not surprised to note that Kissinger had no interest in formulating a true national security policy. He was totally obsessed with his own plans to dominate the foreign policy conversation and getting rid of William P Rogers, the US Secretary of State. In the face of such moral bankruptcy, India’s Prime Minister Indira Gandhi had boldly launched her Secret War in East Pakistan and I am glad that I had participated in the training of Bengali guerrilla fighters and later initiated the Liberation of Bangladesh on 03 November, 1971 with military action in the Chittagong Hill Tracts with attacks on Pakistani border posts deep inside the enemy territory.

    On March 25, 1971, the Pakistani Army launched a devastating military crackdown on restive Bengalis in what was then East Pakistan. While the slaughter in what would soon become an independent Bangladesh was underway, the C.I.A. and State Department conservatively estimated that roughly two hundred thousand people had died (the official Bangladeshi death toll is three million). Some ten million Bengali refugees fled to India, where untold numbers died in miserable conditions in refugee camps. Pakistan was a Cold War ally of the United States, and Richard Nixon and his national-security advisor, Henry Kissinger, resolutely supported its military dictatorship; they refused to impose pressure on Pakistan’s generals to forestall further atrocities.
    My new book, “The Blood Telegram: Nixon, Kissinger, and a Forgotten Genocide,” tries to reconstruct this dark chapter of the Cold War, using declassified documents, investigative reporting, and countless hours of White House tapes, including about a hundred newly transcribed conversations. Thanks to the secret taping system that he installed to record his own blunt conversations, Nixon inadvertently left behind the most transparent Administration in American history. The tapes offer the most revealing account of Nixon and Kissinger’s raw thinking. Staffers at the White House and the State Department were often more pragmatic than their principals, so the documents they produced make the Administration appear more moderate than it was. It’s only on the audio tapes that Nixon and Kissinger’s full radicalism is on display.
    But the White House tapes are maddeningly hard to use. The State Department’s official historians have done excellent work in declassifying some of the most sensitive discussions, but to this day, particularly embarrassing portions of the tapes are bleeped out on the basis of specious national-security concerns. (I’ve made my own requests for a mandatory declassification review of these bleeps under the terms of an executive order.) The tapes remain a largely untapped resource, in part because they are enormous, unwieldy, badly organized, often bleeped, crackly, laborious to transcribe, and hard to understand.
    You can hear Nixon and Kissinger at work in the following audio clip, which is followed by an annotated transcript I made for “The Blood Telegram.” (Some snippets from this conversation are available in a volume of the State Department’s “Foreign Relations of the United States” series, but this is the first full transcript.) This discussion, which also involved the White House chief of staff, H. R. Haldeman, took place not long after the start of the crackdown in East Pakistan. Nixon and Kissinger are having one of their typically prolix and digressive conversations, concentrating this time on foreign policy. The tape is unusually clean: the sound quality is good, and there are no bleeps, though there is some music playing in the background.
    The clip below begins just as the conversation has turned from the Vietnam War to the possibility of an opening to China. To establish communications with Mao Zedong’s regime, the White House was exploring several clandestine channels, including messages carried to the Chinese leadership by Romania’s Communist despot, Nicolae Ceausescu, and Pakistan’s military dictator, General Agha Muhammad Yahya Khan, known as Yahya. The Pakistan channel would soon culminate in Kissinger’s first secret trip to Beijing, in July, 1971. He flew direct from Pakistan, which provided an airplane and a cloak-and-dagger cover story—another reason for the White House to support Pakistan even as the killing continued.

    NIXON: Now, another thing. I want to know about Yahya and Pakistan.

    Nixon had a great personal fondness for Pakistan’s military ruler, who was carrying out the brutal crackdown on the Bengalis. “He’s a decent man,” Nixon repeatedly said, as the death toll mounted.

    I want to be sure that we’re not caught in a crack here where State then puts out a whole lot of stuff that they’ve done. Now Bill has not said that he wants to say anything about Pakistan, has he?

    The President seems to be making sure that the distrusted State Department would not, on its own, condemn Yahya for killing Bengalis. “Bill” is William Rogers, Nixon’s ineffectual Secretary of State, who had been reduced to near-total irrelevance by his rival Kissinger.

    KISSINGER: No.
    NIXON: Has Sisco?

    Joseph Sisco, the headstrong assistant secretary of state for Near Eastern and South Asian affairs, was a particular annoyance to Nixon and Kissinger, who would later call him “a maniac” and “such a whore.”

    KISSINGER: No. But it’s out there, out there [indistinct]. The Dhaka consulate is in open rebellion.

    American diplomats in East Pakistan, horrified by the slaughter, had been reporting the killing in gruesome detail. On April 6th—just a few days before this conversation—the U.S. consul general in Dhaka, Archer Blood, sent a telegram signed by almost all of the U.S. officials in East Pakistan, formally voicing “strong dissent” from the White House’s pro-Pakistan policy, which they characterized as “moral bankruptcy” in the face of “genocide.” In retaliation, Nixon and Kissinger would soon eject Blood from his post in Dhaka.

    NIXON: I understand…[indistinct] I want to know how we can respond to it [indistinct]. We’re going to be…[indistinct] you know what I mean?
    KISSINGER (emphatically): Mr. President, we’re going to wind up on the worst side if we start backing a rebellion there now.

    Though Nixon and Kissinger were discussing actual rebellions in East Pakistan and Biafra, Kissinger was also accusing Blood of “open rebellion” for having sent his formal cable of dissent through official channels. Kissinger would later call Blood “this maniac in Dacca, the Consul General who is in rebellion.”

    NIXON: But Bill—but Henry, we did not back the rebellion in Biafra, did we?

    Even before the crackdown in East Pakistan began, U.S. officials had warned that the country could descend into the kind of bloody chaos that had recently been seen in Biafra, an oil-rich region of Nigeria that attempted to secede in 1967. The Nigerian government managed to crush the Biafran resistance in 1970. As a candidate for President in 1968, Nixon had denounced genocide in Biafra; by 1971, yesterday’s inaction in Biafra had become a rationale for today’s support of Pakistan.

    KISSINGER: That’s right.
    NIXON: That’s a hell of a lot more reasonable. I know, there are less people in Biafra. Is that the reason? Does morality become—look, there weren’t very many Jews in Germany.

    As Nixon knew, Kissinger was one of those German Jews; at least thirteen of his close relatives had been murdered in the Holocaust.

    KISSINGER (murmurs): That’s right.
    NIXON: Was it immoral—was it therefore not immoral for Hitler to kill them?

    Nixon, unprompted, is comparing the slaughter in East Pakistan to Biafra and the Holocaust.

    KISSINGER (murmurs): That’s right.

    Kissinger goes along with Nixon’s comparison of Hitler and Yahya, but still maintains his support for the Pakistani dictator.

    NIXON: See, that’s my— [indistinct] And the Biafrans are black— [indistinct] Catholics!

    This part is hard to hear, but may be about how Americans ignored the Biafrans because they were black, and about Catholic support for the Biafran cause. As Nixon later said, “Biafra stirred up a few Catholics.”

    KISSINGER: Mr. President, if we get in there now—
    NIXON (cross-talk): It’s ridiculous.
    KISSINGER: —we get West Pakistan turned against us, and we get—the Bengalis are going to go left anyway.

    The State Department had repeatedly noted that the Bengali leadership was quite pro-American, but Kissinger dismisses that.

    NIXON: Yeah.
    KISSINGER: They are by nature left. Their moderate leadership is in jail, maybe they shouldn’t have been put in jail, but that’s the way it is now, and, uh—

    Kissinger realizes he’s made a wrong turn, is actually criticizing Yahya, and falls awkwardly silent.

    NIXON: I just want to [indistinct]… get a little work… [indistinct] Is that in the West—West Pakistan thing or not? [indistinct]
    KISSINGER: Why don’t you wait ’til Wednesday, Mr. President, when we have the meeting and then we can get a paper to you.
    NIXON: All right.
    KISSINGER: Because I am afraid in the present state of the State Department if you interfere too early—
    NIXON (annoyed): I’m not interfering, I just want to know what he thinks!

    Nixon snaps at Kissinger for the nonstop bureaucratic combat against Rogers. To handle Kissinger’s obsessive feuding with the Secretary of State, the President had Haldeman set up an informal “Henry-handling committee.” In the end, Kissinger drove Rogers out, and claimed both top foreign-policy jobs, national-security advisor and Secretary of State.

    KISSINGER: Well, he’s going to submit a paper to us and then you’ll know what you think—what he thinks.
    NIXON: Oh. He’s going to submit a paper?
    KISSINGER: Yeah.
    NIXON: You’re sure he knows I want it?
    KISSINGER: Oh yes, he knows you want it. No, he’s—Bill is all right.

    Kissinger starts to walk back, trying to praise Rogers.

    Bill is—
    NIXON: I just got to know what the hell they think. I mean, I’m not trying to—… [indistinct] I think if we get in the middle of the whole thing [indistinct], it’s a hell of a mistake.
    KISSINGER: It’s a disaster. No one else is doing it.
    NIXON: Look—let’s face it. The people that bitch about Vietnam bitched about it because we intervened in what they say was a civil war.

    This was one of Nixon’s most potent arguments to silence Americans who were outraged by the suffering in East Pakistan. Democrats like Ted Kennedy, the White House argued, were simply trying to drag the United States into another civil war in Asia.

    KISSINGER: That’s right.
    NIXON: Now some of those same bastards, like… [indistinct] want us to intervene in Biafra. And some of those same people want us to intervene here. Both civil wars. Real civil wars. Now what in the hell are we talking about?
    KISSINGER: They want us to cut out economic aid to West Pakistan.
    NIXON (surprised): For what reason?

    Kissinger is careful to defend U.S. aid to the Pakistani military government, despite the atrocities. Blood had argued that the bloodshed in East Pakistan was a very good reason to cut off economic aid to Yahya.

    KISSINGER: It’s—pure doctrinaire reasons. Because India is screaming in turn, because they’re scared to death of their own Bengalis. Deep down the Indians don’t really want an independent East Pakistan, because within ten years of that the West Bengalis are going to start bringing pressure on them for autonomy. It’s a classic situation for us to stay out of. There’s nothing for us in there to take sides in this. And for us to cut off aid will infuriate the West Pakistanis.

    Millions of Bengalis in India were deeply shocked by the killing of their brethren across the border in East Pakistan. The Indian state of West Bengal, unstable and impoverished, was already a headache for the Indian government—and the crackdown in East Pakistan sent some ten million refugees fleeing into India’s border states, above all into West Bengal. This left the Indian government fearful of further unrest in the state, and desperate to find a way to get the refugees to return home. India secretly sponsored Bengali guerrillas fighting back against Pakistani troops. Finally, in December, 1971, India and Pakistan would fight a brief fourteen-day war, ending with an Indian victory and the creation of the new country of Bangladesh.
    Unlike Blood and the other Americans in Dhaka, Kissinger seems not to realize that the loss of so many Bengali lives might impact American foreign policy. For all his mastery of the use of American leverage, he nevertheless rules out the possibility of applying any pressure on the Pakistani military.

    China’s Doctrine of Neocolonialism: China just like the imperialistic powers of the 19th century has established the doctrine of Neocolonialism to control the economic and human resources of the countries China colonized. The vast continent of Africa has virtually transformed into a Chinese Colony. The process of regulating and dominating the market of the Rare Earth Elements is no different. China is able to influence the market conditions by manipulating the political establishments of the countries it has colonized. China’s Expansionism includes expansionism in all its dimensions including influencing the cultural beliefs of the people.

    China occupied Tibet, an independent country by using its military force in 1950. I understand that Tibet is the major source of some of these Rare Earth Elements. In my analysis, China’s domination cannot be effectively checkmated without the emancipation of the oppressed Tibetan people. During the Cold War Era, the United States spent billions of dollars to arrest the spread of Communism viewing Communism as a threat to freedom, democracy, peace, justice, and human rights. Now, the world will be forced to recognize the economic inequity imposed by China’s Neocolonialism.

I’m not comfortable with the fact that we now have to buy magnets for our bombs from China,” said the exasperated Senator Hillary Clinton in a speech in Pittsburgh on April 14, 2008. Ten years later, in May 2018, the Department of Interior of the US Government published a list of 35 mineral commodities including the ‘rare earth elements group’ and classified them as “critical mineral”, as they were considered critical for the economic and national security of the United States.

    Whole Dude - Whole Declaration: Thomas Jefferson(b. April 13, 1743 - d. July 04, 1826), 3rd President of the United States(1801-1809), the  principal author of The Declaration of Independence adopted July 04, 1776. It was a declaration of the principles to support the demand for Independence. His personal commitment to its principles was profound and intense. He became a symbol of the ideals expressed in the Declaration.

    On February 17, 1801, Thomas Jefferson is elected the third president of the United States. The election constitutes the first peaceful transfer of power from one political party to another in the United States. I coined the phrase ‘Whole Declaration’ to celebrate the legacy of the third US President.

    DECLARATION FOR FREEDOM FROM TYRANNY AND UNJUST RULE:

    The Declaration of Independence is the most important of all American historical documents. It is one of the great political documents of the West. The Declaration was drafted at the Second Continental Congress while the delegates of the thirteen colonies convened in Philadelphia had decided to proclaim freedom from British rule and wanted to make a formal pronouncement of their rights as people to form a government by choice. The Declaration affirmed the natural rights of man and the doctrine of government by contract. The Declaration gives a detailed enumeration of specific grievances and injustices and contended that the colonies had the right and duty to revolt.

    DECLARATION OF NATURAL RIGHTS AND THE RIGHT TO REPRESENTATIVE GOVERNMENT:

    Jefferson rarely made speeches, disliked oral disputes, and he preferred pen as the natural means of his expression. He wrote a political pamphlet, “A Summary View of the Rights of British America” (1774), arguing on the basis of natural-rights theory, he claimed: “The God who gave us life gave us liberty at the same time: The hand of force may destroy, but cannot disjoin them.”  It was the fact of his commitment to the principles of the Declaration and not the mere fact of literary authorship that makes Jefferson a unique symbol of Independence. Jefferson was clearly inspired by John Locke(1632 – 1704), English philosopher and founder of British School of thought known as ‘Empiricism’. Locke was a leading philosopher of freedom and in his political theory , he maintained that the original state of nature is happy and is characterized by reason and tolerance; all human beings are equal, and free to pursue “life, health, liberty, and possessions.” The state formed by the Social Contract is guided by the natural law which guarantees those natural inalienable rights.

    DECLARATION OF FIRM RELIANCE UPON DIVINE PROVIDENCE:

    While Jefferson drew upon the English and French Enlightenment as sources for his ideas, and used language to structure his argument to closely parallel the natural rights theories of Locke, he made a great exception. Jefferson substituted the “pursuit of happiness” for “possessions” in the trinity of inalienable natural rights. In this one key aspect, Jefferson used ‘Natural Law’ instead of natural rights theory. Jefferson showed acute awareness of the problem of corruption caused by concentration of wealth, and property in the hands of a few individuals. He emphasized public duty rather than personal choice. He thought that happiness is attainable only by diligent cultivation of civic virtue. The Declaration reads: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness.— That to secure these rights, Governments are instituted among men, deriving their just powers from the consent of the governed…… And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honour.” Jefferson suggested that man’s pursuit of Happiness and other rights demands a firm reliance on the protection of Divine Providence. If man finds satisfaction under the protection of Divine Providence, he would not claim the right to disproportionate wealth, income, possessions, and property.

    DECLARATION OF FREEDOM FROM UNEMPLOYMENT:

    Jefferson had correctly predicted that the Rulers would become corrupt and abuse their power, and the people “will forget themselves, but in the sole faculty of making money, and will never think of uniting to effect a due respect for their rights.” Jefferson stated that a representative government would operate successfully only under certain conditions: 1. a wide distribution of property or the availability of a substitute that provided men with decent subsistence honestly earned, 2. an educated and informed population, and 3. laws and institutions designed to compensate for the diminution of public virtue that was sure to come when the crises of the revolution were over. While he was the Secretary of State( from September 1789), Jefferson came to distrust the proposals and the motives of the Secretary of Treasury Alexander Hamilton. Jefferson thought Hamilton’s financial programs were both unwise and unconstitutional and felt that the financial policy was flowing “from principles adverse to liberty.” He had openly expressed his disagreement in opposing Hamilton’s policies for they exceeded the powers delegated to the Federal Government by the Constitution, they were contrary to the interests of the majority of the people, and that they represent a threat to public institutions. Eventually, Jefferson resigned on December 31, 1793 for he was dissatisfied with issues like the bill incorporating a “Bank of the United States.” Jefferson’s plan for comprehensive reform of the laws and institutions of Virginia included an effort to secure abolition of the laws in order to discourage concentration of property in the hands of a few great landowners. He believed that property was among the natural rights to which man was born and that it meant the right to a decent means of subsistence. “Whenever there is in any country, uncultivated lands and unemployed poor, it is clear that the laws of property have been so far extended as to violate natural right. The earth is given as a common stock for man to labor and live on.” Jefferson held that a representative government cannot flourish in conditions of extreme poverty or complete economic dependence. Jefferson as the US President reduced internal taxes, the military budget was cut, and made plans to extinguish the public debt. Simplicity, and frugality became the hallmarks of Jefferson’s administration.

    Jefferson authored the Statute of Virginia for Religious Freedom which had initially faced very stiff opposition. The Statute constituted a complete break with the traditional relationship between Church and State. Freedom of Mind and Freedom of Conscience to let people form their own opinions without favor or fear is a great accomplishment of his life. Jefferson’s bill on religious liberty reads: “that all men shall be free to profess, and by argument to maintain, their opinions on matters of religion, and that the same shall in no wise diminish, enlarge, or affect their civil capacities.” The Bill got passed in 1786 by James Madison and Jefferson thanked him and sent him a letter which reads: “The reason of man may be trusted with the formation of his own opinions.”

Educators at this University of Virginia and other places of higher education must continue to investigate the reasons for inequalities among men. Men are born equal, but live their entire lives coping with unjust inequalities.

    Jefferson’s comprehensive plan for a representative government had included a plan for the educational system. Ignorant people could not make rational, and responsible decisions about public affairs. Education provides an opportunity to the development of talents and capabilities suited for public office. However, he had cautioned that educational opportunity must not be identified with economic privileges. I want to know as to what our students and educators think about the extreme concentration of wealth in the hands of a few people in this country.

    Jefferson died on July 04, 1826, the 50th anniversary of the proclamation of the Declaration of Independence. He had directed us to remember only three achievements in his public life that symbolize his quest for true human freedom. Unfortunately his predictions about people who govern and people who get governed have come true.

    This should not come as a big surprise to read about gross inequalities in the distribution of wealth within the United States. The suspicions of Thomas Jefferson have come true. The rulers have become corrupt, and the people are only concerned about increasing their personal wealth. Education is not a tool for informed public opinion, and it simply serves the greed to satisfy the desire for economic privilege. There are no laws and there are no institutions to compensate for the diminution of public virtue. The government no longer represents an institution created by social contract. The government is following financial policies that eroded the liberty, freedom, and equality of the people. The clearest evidence for the loss of Freedom is the phenomenal increase of national and private indebtedness and the dependence upon foreign capital to run the daily operations of the government. Freedom is at peril in the United States and I am afraid that ‘The Declaration of Independence’ would be a mere historical document worthy of its being exhibited in a museum.
